Overview

David Kresser joined Fisher & Phillips after graduation from law school and the firm elected him to partnership in 1993.  David litigates employment claims and provides counseling and other legal services to employers across the country.  David recognizes that employment claims represent a business problem and he strives to quickly and efficiently resolve them based on the unique needs of each client.

David represents large, multi-national corporations and small businesses and non-profit companies.  He has extensive experience handling claims covered by employment practice liability insurance.  His litigation practice runs the gamut from single plaintiff discrimination cases to class and collective actions.  David has tried both jury and non-jury employment cases and was the principal drafter of the employer briefs filed with the U.S. Supreme Court in Desert Palace, Inc. v. Costa, 539 U.S. 90 (2003), a case involving Title VII standards of proof.
