Overview

Bret Martin’s practice includes all areas of labor and employment law, with a focus on litigation, wage-and-hour class actions, harassment, discrimination, retaliation, wrongful termination cases, and prevailing wage law. Bret also devotes a significant amount of his practice to providing clients preventative advice on everything from employee hiring, discipline, terminations, leaves of absence, workplace accommodations, and generally counselling clients on complying with California’s ever-changing legal landscape.

Bret has successfully represented clients at mediation, arbitration, before governmental agencies, as well as in both state and federal court. Bret represents employers in a variety of industries, ranging from hospitality, manufacturing, medical, automotive, retail sales, financial services, and much more.

Bret has successfully drafted and argued numerous motions in state, federal, and arbitral forums. Recently, Bret obtained a complete dismissal with prejudice of a disability discrimination, retaliation, failure to accommodate, and wrongful termination case, after the Judge issued a tentative ruling granting in full a motion for summary judgment filed on behalf of the employer.

Bret graduated magna cum laude from the University of San Diego School of Law, where he was a member of the San Diego Law Review and participated in the Duberstein Moot Court competition. Bret also worked full time as a manager at a small business during law school. After graduation, Bret spent a year clerking for a federal judge in Los Angeles before joining Fisher Phillips’ Irvine office.
