
Overview
Kate Finley is an associate in the firm’s Atlanta office and a member of the Employee Benefits Practice Group. Her practice is focused on counseling employers in a variety of employee benefits matters and through all stages of an employee benefit plan’s life. Kate works to understand her client’s goals and concerns in order to reach the best possible outcome, whether the goals involve adding new benefit arrangements, amending existing plans, or terminating and winding down a benefit plan. She routinely advises employers on complex day-to-day issues arising under ERISA, the Internal Revenue Code, and other federal laws governing employee benefit plans and programs.
Kate has guided clients through IRS and DOL audits of benefit plans. Clients rely on her advice to address errors under employee benefit plans and to assess potential exposure. In doing so, Kate works with employers to submit correction applications through available programs with the IRS and the DOL order to preserve the qualified status of plans and to avoid or reduce potential penalties and other costs. She has filed corrections for employee benefit plans with minor errors in a single year and for plans with significant errors spanning years.
Kate also advises employers on complex employee benefits and executive compensation aspects of mergers and acquisitions.
Prior to joining Fisher Phillips, she practiced employee benefits and executive compensation law at both a full-service, international law firm and a small employee benefits firm.
