Todd Fredrickson was quoted in Law Week Colorado on November 16, 2015. The article “Untruthful Termination Can Jeopardize Release Agreements” addressed how allegations of fraudulent firing could defeat a claims waiver in the Hawks v. Ballantine case.
Todd said that accurately representing the reasons for firing an employee is “absolutely critical” with respect to the enforceability of waivers and releases.
“I regularly counsel employers to give an overview of the reason the employee is being terminated … and not get into a protracted conversation, because that doesn’t serve anyone’s purpose,” he said.
