Tampa Attorney Explains Employer Defenses Under the WARN Act

In a Tampa Bay Business Journal article regarding the abrupt closure of a large medical facility in the Bay area, Fisher Phillips attorney Brett Owens is interviewed on the use of the Federal Worker Adjustment and Retraining Notification Act (WARN). The WARN act allows several affirmative defenses for employers during plant closings and layoffs. Brett tells reporters that the “faltering company” exception could only be used by plants closing, but the “unforeseeable business circumstances" defense may be a possibility the medical facility could use.
