Invading Your Employees’ Privacy: Finding a Balance Between an Employee’s Freedom and an Employer’s Need to Monitor
Employers want to be sure their employees are doing a good job, but employees don't want their every action monitored. What employers can monitor and to what extent employees relinquish their privacy rights has been a long term debate. That debate is becoming increasing complicated with the advancement of technology as traditional rules that govern areas of privacy law are changing. No longer do privacy issues strictly involve surveillance video. Employers now need to know whether they can and should read an employee’s text messages or whether they can review an employee’s personal internet searches. This briefing will look at the current state of the law on workplace privacy as well as how an employer can strike a balance between employee freedom and the Company’s needs.  We will discuss the impact of new technology, considerations for dealing with privacy issues that arise, and what policies and other tools Companies might need in dealing with workplace privacy issues.
