
Overview
David Harvey has over two decades of labor and employment law experience and advises employers on numerous workplace-related matters, including wage and hour issues under the Fair Labor Standards Act (FLSA) and class and collective actions, claims of discrimination involving Title VII, the Americans with Disabilities Act (ADA), the Equal Pay Act, the Age Discrimination in Employment Act (ADEA), and whistleblower/wrongful discharge actions. His experience includes assisting employers in all aspects of Office of Federal Contract Compliance Programs issues for service and supply contractors and construction contractors, including affirmative action plans under EO 11246, VEVRAA, Section 503, compliance reviews, and compensation issues.
Additionally, David advises on workforce planning, including RIF strategy and compliance with The Worker Adjustment and Retraining Notification (WARN) Act, state plant closure laws, and the Older Workers Benefit Protection Act (OWBPA). He also has experience in traditional labor matters such as union campaigns, arbitration, certification and decertification elections, ULPs, and other labor-management issues.
Before joining Fisher Phillips, David was counsel for an international labor and employment-focused law firm where he worked with trial teams to conduct fact and legal investigations and exposure assessments for class, collective, and representative actions, including PAGA matters.
David has authored a variety of news articles and blog posts and presented on topics including OFCCP compliance, RIFs, wage and hour law, employee performance management, prevailing wage law, compensation analysis, and equal pay.
