Wage and Hour Issues Employers are Watching Under Biden Administration

Employers are bracing themselves for a wave of policy actions on the wage and hour front as Joe Biden takes office. In an interview with Law360, Hagood Tighe, co-chair of Fisher Phillips’ Wage and Hour practice, takes a look at employers’ top wage and hour priorities as the White House changes hands. One of the top issues employers are watching is policy changes around worker classification. It’s possible the Biden administration may do away with the recently passed employment test and favor the three-part standard similar to California’s ABC test. While it’s unclear how things might change, Hagood notes that a standard that comes out of Congress might be more lenient toward employers than a new White House rule.

The article also takes a close look at Biden’s push for a higher minimum wage. Hagood says if the minimum wage is increased, he thinks that provides additional fodder for arguments that at some point in the future it will be important to increase the salary basis for exempt classifications.
