In interviews with various media outlets, Kevin Troutman shares his insights on a Court’s ruling upholding a Houston hospital system’s mandatory COVID-19 vaccination policy. In one of the interviews, Kevin explains to MarketWatch that the ruling indicates that “when push comes to shove, employers may have a good chance arguing their COVID-19 vaccine requirements stand up in court.” At the same time, Kevin is quick to point out that the case also highlights some of the drawbacks that might arise if employers decide to mandate the vaccine. He notes that “requiring vaccines can generate bad blood with some staff and headline-grabbing lawsuits that can be a distraction from business.” Thus, although the Court’s ruling in this particular case supports the legality of vaccine mandates, Kevin still thinks it is important for employers to weigh their options and determine if they can maintain a safe workplace without a mandate to avoid the potential for lawsuits and the other distractions that might arise as a result of implementing such a policy.
