Employers should be particularly careful around unauthorized work hours, misclassified employee status, unrecorded remote work and stand-by hours, and independent contractor work. “Convenience stores are at special risk of overtime violations because they have a substantial hourly worker base,” Marty explained, adding that he expects additional worker-friendly policies coming out of the Biden administration.
