Scott was quote on his take of discrimination cases that follow mass layoffs.
Discrimination cases after mass layoffs don’t normally go far, according to Scott Schneider, a labor and employment attorney with Fisher and Phillips. The plaintiff would need to prove that he or she was part of a larger group of individuals in the same protected class, fired for their race, gender, age, or religion, for example.
“The labor and employment practice is counter-cyclical. When the economy is down and people are getting fired, it’s a good time for us. (In) the recession following the real estate collapse, there was a real spike in litigation claims,” he said.
