In addition, consideration of an applicant’s criminal background is coming under increasing scrutiny as ban-the-box legislation continues to gain momentum, public attention is focused on potential bias by law enforcement, and the EEOC enforces its Guidance on Consideration of Arrest and Conviction Records in Employment Decisions Under Title VII of the Civil Rights Act of 1964.
