The 2024 PAGA reforms were projected to shrink PAGA claims, but 2026 is on pace to be the biggest year on record, with an average of 849 LWDA notices per month. While the reforms introduced meaningful new defenses, including penalty reductions of up to 85% for employers who take "all reasonable steps" and expanded cure rights, filings have continued to climb. This session, led by Partners Hannah Sweiss and Nathan Low, will examine post-reform trends, how the new compliance and litigation tools are playing out, and the mitigation and prevention strategies employers and their counsel can deploy to reduce exposure.
