Workplace Safety Attorneys Discuss Occupational Safety and Health Review Commission Quorum

Commissioner Cynthia Attwood will leave the Occupational Safety and Health Review Commission (OSHRC) at the end of April, leaving the commission without the numbers needed to form a quorum. Partners Ed Foulke and Travis Vance spoke with Bloomberg Law on the impact this may have on case reviews. Ed says the loss of quorum doesn’t just mean a possible slowdown in safety case reviews – employer could also see higher costs for appealing citations and a worse chance of prevailing. Travis added, “OSHRC was giving us a lot of interesting decisions in regards to repeat citations and Lock Out/Tag Out – now that will come to a screeching halt.”
