Tampa Partner Quoted in SHRM on New FMLA Certification Expiration Dates
The U.S Department of Labor announced that its Family and Medical Leave Act (FMLA) certification forms and notices are valid until Aug. 31, 2021. While use of the forms isn’t mandatory, many employers use them. In the SHRM article “FMLA Forms Extended Through August 2021,” Steve Bernstein cautions employers who use and customize the DOL-recommended forms that they “can be held liable for using a form that harms the employee by misleading him or her about FMLA rights.” He recommends that any changes be reviewed by an outside expert to ensure that added language does not inadvertently conflict with the FMLA.
