Sometimes Alternative Dispute Resolution is an option for employers with matters in front of the National Labor Relations Board and sometimes it’s not. In an article published by SHRM, Steve Bernstein explains the cases where ADR is not an option for employers, such as when elections were conducted fairly or if a union has made the required showing of interest in support of a petition for unionization.
