OSHA Inspections: Know Your Rights, Responsibilities (Part 1)

Ed Foulke, a partner and co-chair of the firm's Workplace Safety and Catastrophe Management Practice Group in the Atlanta office, was quoted in the American Laundry News article “OSHA Inspections: Know Your Rights, Responsibilities (Part 1).”

The article, first in a series, focuses not only on the importance of having workplace safety programs in place, but also the need for employers to understand their rights during OSHA inspections.  In the article, Ed discusses the importance of having a list of safety rules established and to make sure all employees are aware of these rules.

“Make sure that they are aware of the list and then when they violate those programs, they can be disciplined,” Ed said.  He added that discipline can be used as an “affirmative defense” to demonstrate to OSHA that the employer has taken steps to prevent employee misconduct.
