Lawyer Weighs-In on What GCs Should Consider When Hiring Remote Attorneys

In an interview with Law360, Ray Perez discusses some of the considerations that employers should keep in mind when hiring permanent remote lawyers. He explains that there are issues surrounding attorney licensing and warns general counsel about the potential risk of the unauthorized practice of law that could accompany a remote arrangement. Ray cites the American Bar Association’s Model Rule 5.5, which states “’a lawyer shall not practice law in a jurisdiction in violation of the regulation of the legal profession in that jurisdiction, or assist another in doing so.’” He explains how this rule and other state licensing rules might impact in-house lawyers working continuously from home.
