Fisher Phillips Partner Comments on Ruling Over ACA Validity


A federal judge in Texas ruled that the entire Affordable Care Act (ACA) is invalid, leaving attorneys questioning the future of the program and enforcement. Cleveland Partner Jeff Smith spoke with reporters from Law360 on where the ACA stands and what future litigation may arise. While this ruling generally means that employers remain the status quo, when asked about whether future rulings could be made on the ACA, he said, “I don’t think [an injunction] is off the table. It could be issued later.” Meaning, employers will need to keep an eye on these developments.
