So what’s more risky – doing background checks or potentially having criminals in your workplace??? Employers are struggling to navigate the muddy waters created by EEOC guidelines regarding how they should conduct criminal background checks. In many cases, employers are forced to choose between staying in the good graces of the EEOC and risking a negligent hiring charge. The landscape is even further complicated by increasing “ban the box” legislation and the need to comply with the statutory requirements of the Fair Credit Report Act.
