ADA Update:  What’s Reasonable?

The duty to provide “reasonable accommodation” of applicants’ and employees’ physical and mental disabilities is a fundamental requirement under the Americans with Disabilities Act (ADA).  Colorado’s Anti-discrimination Act extends the same requirement to the smallest of employers.  What’s reasonable necessarily depends upon the situation, and may be viewed differently by employers and government agencies.  Some guidelines have emerged in the years since these laws were passed.  This program will focus on developments in the EEOC’s position and court cases interpreting what’s reasonable and address how to identify requests for accommodation, engage in the “interactive process,” handle medical and other documentation, and avoid discrimination.
