Deepa Desai recently spoke with Law.com following the Massachusetts Supreme Court’s ruling that the so-called ABC test in the independent contractor statute applies to the franchisee-franchisor relationship. The ruling, stemming from Dhananjay Patel v. 7-Eleven, could lead to an influx of misclassification litigation said Deepa.
Considering the outcome, Deepa encouraged franchisors to review their franchise agreements, policies and guidelines to determine whether franchisees are “truly owning and operating independent businesses.” If not, it’s important to determine what modifications to the agreements need to be made, she said.
