Mitchell Anderson is a member of Fisher Phillips’ Workplace Safety Practice Group.
Mitch helps employers manage and defend OSHA inspections and enforcement actions encompassing a broad range of industries, including manufacturing, commercial construction, warehousing & third-party logistics, oil and gas, maritime operations, heavy equipment rental, agriculture, metals recycling, solar energy, food safety & sanitation, and private contractors on military bases.
An experienced litigator, Mitch has handled and assisted with state and federal OSHA litigation matters in Alaska, California, Hawaii, Oregon, Washington, Nevada, Arizona, Iowa, Missouri, Arkansas, Kentucky, Tennessee, Michigan, North Carolina, Georgia, Florida, Pennsylvania, and Massachusetts.
Mitch is also a member of the Workplace Safety Rapid Response Team and regularly travels to worksites across the country following fatalities, amputations, and other serious incidents. Mitch initiates and directs root-cause investigations, prepares on-site personnel for inspections, and acts as employers’ “walkaround representative” during OSHA’s physical inspections of worksites. Following on-site inspections, Mitch counsels and defends employers through the conclusion of OSHA’s investigation and, if necessary, enforcement litigation. Collectively, these measures and others help improve workplace safety, prevent needless citations, and minimize the risk of related civil liability. To date, Mitch has attended and handled OSHA inspections in more than 25 states.
In addition to conventional workplace safety compliance counseling and enforcement defense, Mitch helps employers navigate and defend whistleblower claims arising under state and federal OSHA statutes and the Seaman’s Protection Act.
