Workplace Safety Lawyer Comments on OSHA’s Dismissal of COVID-19 Whistleblower Cases

According to a recent report, the Occupational Safety and Health Administration (OSHA) has closed without investigation more than half the complaints it's received from workers alleging they were punished for raising COVID-19 safety concerns. In an interview with Law360, Howard Mavity explains that he thinks OSHA has closed many of these whistleblower cases because they have not passed the “smell test.” Howard believes that “[i]n many of those cases, workers were fired after refusing to work despite their employers following government safety recommendations, which is not illegal retaliation.”
