In an interview with Bloomberg Law, Workplace Safety Co-Chair Todd Logsdon shares his insight on how mental health may be the next target for workplace safety advocates, as many proponents say OSHA's mental health guidance is insufficient. Todd explains how the current OSHA standard sets a high bar if the employer challenges the citation in court, particularly if the basis is a mental health issue. "I think you’d have to have something almost to the point of intentional," said Todd.
And, when discussing record-keeping obligations, he said the impetus for listing a mental health case in the OSHA log is with the workers because they must provide the documentation showing that the illness relates to their jobs.
