Widespread Cannabis Legalization Not Expected Soon in Texas, Houston Managing Partner Says

Despite recent Texas legislation making it easier for patients to take advantage of the state’s limited medical marijuana program, employers should not expect across-the-board legalization of cannabis anytime soon, according to Steve Roppolo, managing partner of the Houston office. Writing for Law360, Roppolo points out that the Texas Department of Public Safety suspended the application for companies seeking permits to cultivate and dispense the low-THC cannabis products authorized by the state. In the meantime, some Texas employers are choosing not to test for marijuana or not to use positive THC results as grounds for terminating an employee or refusing to hire an applicant.
