In an interview with Law360, Melissa Camire and Justin Reiter provide insight on what employers need to know about marijuana legalization in New York. Justin suggests that employers should approach testing with caution and explains that while the law makes clear it's not intended to limit the authority of employers to enact and enforce policies pertaining to cannabis in the workplace, you cannot just take action against an employee because of that test result. Additionally, with all of the new state marijuana laws popping up across the country, there remains some confusion around testing for employers who fall under federal regulations. The New York law has some exceptions but Justin says employers are still awaiting some guidance on exactly could cause a federal contract to be revoked under an exception to the state’s new law.
