Wage and Hour Co-Chair Discusses the Department of Labor's Reluctance to Release Opinion Letters

In an interview with Bloomberg Law, Kathleen Caminiti shares her insights on the DOL’s Wage and Hour Division's decision not to issue opinion letters, which has caused anger and confusion for many employers and management-side attorneys who believe the directives are helpful for decoding complex labor laws.

She explains that moving away from opinion letters limits the ability to gut check a [wage and hour] practice for an employer. "By issuing something that is more general, we are able to provide guidance to folks who want to comply with the law and to workers who are in these situations about what to do," Kathleen says.
