Wage and Hour Co-Chair Discusses Expense Standards for Pizza Delivery Drivers

In an interview with Law360, Kathleen Caminiti reflects on the legal gray zone of expense standards for pizza delivery drivers – an issue that may for the first time get a federal appellate court’s review.
In March, an Ohio federal court certified an interlocutory appeal in a case where drivers are challenging the “reasonable approximation” standard over the standard mileage rate. Kathleen said that while lower courts tend to favor the “reasonable approximation” standard, more clarity on the issue would be welcomed by employers.
"These are low-margin pizza makers," she said. "The litigation is really crippling. So, to have a high court confirm long-standing law would be welcome."
