A U.S. Supreme Court case could require the public disclosure of additional information that employers share with the Official of Federal Contractor Compliance Programs (OFCCP). In an interview with Law360, Columbia partner Cheryl Behymer discusses the potential chilling effect of a forthcoming ruling in Food Marketing Institute v. Argus Leader Media. According to Behymer, if the high court, in this case were to take an approach that makes it more likely that agencies will approve Freedom of Information Act requests for companies' sensitive data, companies may shy away from handing over extra information to the OFCCP if they aren't required to do so.
