The article, “Trump's Picks for Labor Board Could Raise Conflicts Issues,” featured in The National Law Journal, discussed how President-elect Donald Trump takes office with the unusual situation of ownership of companies that are involved in disputes with federal agencies including the National Labor Relations Board (NLRB), two of whose members he will get to appoint.
Steve Bernstein weighed in on this unusual situation.
There is a system in place, however, that allows board members to step aside from decisions they believe cause conflicts. Steve said recusal is “used extensively in our court system and before the agencies. It doesn’t always get reported, but these things are commonplace.”
