PAGA lawsuits have sprouted up all over California in the last several years. Huge claims based on one employee’s alleged experience, lead to massive demands, and take away our focus from growing, harvesting, packing, and shipping.
Recently, the California Supreme Court ignored guidance from the U.S. Supreme Court when it ruled that employees can still proceed with their representative PAGA lawsuit in Court against employers even if their individual PAGA claim is compelled to arbitration. This decision will inevitably lead to more lawsuits against California employers and creates another avenue of concern for California’s agricultural businesses struggling with compliance responsibilities.
To answer the question "is there any hope?” we will also discuss when relief may be felt through a 2024 ballot measure that seeks to dismantle the current PAGA structure.
