The article, “Texas Judge Expected to Rule Tuesday on Overtime Regulation,” featured in the Dallas Business Journal, discussed how a Texas federal judge is expected to decide Tuesday whether to halt the U.S. Department of Labor’s new overtime rules from taking effect as scheduled on Dec. 1.
Employers should proceed as if the Dec. 1 rule will take effect, regardless of the decision on the preliminary injunction, said Art Lambert.
“Plan on the Dec. 1 date to be a hard date,” Art said. “A preliminary injunction is a very iffy thing because you haven’t had a full hearing on (the issue) and you haven’t had a trial on it.”
Art called the rule revision the biggest change in labor and employment law in more than 15 years.
“The Internet is going to explode when that opinion comes out,” he said.
The Donald Trump presidential administration may try to immediately reverse or suspend the Department of Labor’s impending changes to the overtime pay regulations, but it would be unwise for businesses to count on that, he said.
