San Francisco Chronicle Interviews Fisher Phillips Partner on State's Ban on Nondisclosure Agreements

In an interview with the San Francisco Chronicle, Ben Ebbink weighs in on the state’s new law banning nondisclosure agreements in certain separation agreements. Advocates say the law, which takes effect Jan. 1, 2022, will further protect employees from harassment and discrimination. But there may be an unintended impact. “The argument had been raised by some that to the extent these type of nondisparagement agreements have value, and they are important to employers that if they cannot include them in these types of agreements,” that would make them less likely to settle," Ben says.
