Katherine Sandberg is quoted in the Daily Journal article “Supreme Court to Hear Arguments Over Whether Arbitration Act Exemption Applies To Transportation Contractors,” where she discusses the upcoming U.S. Supreme Court arguments in Oliveira v. New Prime Inc. The case hinges on whether the Federal Arbitration Act exempts independent contractors and whether that question should be answered by a court or an arbitrator.
Katherine says the case could go either way, but New Prime has the more compelling argument. She says, “I feel confident in saying I don’t think the Supreme Court is going to issue a decision and send the case back to arbitration.”
