Sacramento Attorney Previews Worker Classification Issues in California in 2019

In his bylined article for the Daily Journal titled “Dueling proposals signal 2019 will be the year of Dynamex,” Benjamin M. Ebbink offers a glimpse into two bills introduced for the 2019 California legislative session that focus on worker classification following the state Supreme Court’s ruling in Dynamex Operations West v. Superior Court.
Ben examines Assembly Bill 5, which would codify Dynamex and clarify the decision’s application in state law, and Assembly Bill 71, which would revert worker classification laws back to the previous Borello test. Ben indicates that labor and employment will again be a hot topic in 2019 in Sacramento, especially with incoming Gov.-elect Gavin Newsom and the uncertainty surrounding his stance on worker classification laws.
