Due to the popularity of our recent program, Steve Bernstein and Todd Lyon, co-chairs of the Fisher Phillips Labor Relations Group, are back for a repeat edition of the important webinar designed to prepare employers for the changes in how the NLRB will respond to organizing campaigns. The Board spent big parts of 2023 delivering on promises made during President Biden’s 2020 campaign, and the returns are clear. Organized labor currently enjoys more advantages over employers than at any point since the Obama administration. While a number of splashy decisions have dominated coverage of the union election process, less publicized aspects will have massive practical implications for employers, too. Enter, the return of the “Quickie Election rule." Born of the Obama-era Board, rolled back during the Trump-era Board, and resurrected by the Biden Board in August, this rule will significantly accelerate the time period between union petitions and elections, to the detriment of employers’ ability to respond to a union organizing campaign.
