Private Schools on Notice: 2 Federal Courts Rule that Non-Profit Status Leads to Title IX Coverage

Within the last week, two federal courts – one in Baltimore, the other in Los Angeles – have sent shockwaves through the private and independent school community by ruling that nonprofit status automatically means that such schools are deemed to be receiving federal financial assistance. This has enormous implications, as it means nonprofit schools would be subject to Title IX and a whole host of other federal antidiscrimination laws. Each of these laws carry with them additional responsibilities – and lead to a chance of increased legal exposure.
