Wheatley are quoted for their insight on the legality of labor peace agreements in the cannabis industry. Organizing efforts at a Pennsylvania cannabis store are raising questions about whether the state’s licensing preferences - which open the door for unionization in exchange for labor peace at their stores - will hold up in court. They explain, “given that the state requirements impose obligations where the National Labor Relations Act does not, there is a strong argument that these laws are entirely or largely pre-empted by the NLRA.”
