In interviews with the Pittsburgh Post-Gazette, Arthur Wolfson provides insight into whether employers can legally require their employees to receive the COVID-19 vaccine. Based on the latest federal guidance, employers have some flexibility in determining whether to require the COVID-19 vaccine, recommend it, incentivize it or simply do nothing. Arthur says the short answer is “yes, but…” He advises employers to keep in mind the accommodations required and perception among the workforce. Arthur also cautioned that federal guidance could change again, so employers should keep their eye out for updates from the EEOC.
