In interviews with American City Business Journals, Law360 and Law.com, Pittsburgh partner Jay Glunt breaks down the trends Fisher Phillips is seeing in COVID-19 workplace litigation. Based on data from Fisher Phillips’ COVID-19 Employment Litigation Tracker, the firm crunched the numbers and found a general trend of increased litigation around the pandemic, noting that remote work, leave and discrimination lawsuits make up more than half of the total. Glunt says that employees became accustomed to working remotely when government mandates restricted employers on bringing their employees back to the workplace, but now that less of those exist, we are starting to see an uptick in adverse actions against employers. He also explains that organizations are focusing time and energy on certain polices and practices that are likely to be an area of litigation and navigating them carefully to reduce risk.
