Philadelphia Attorney Discusses OSHA’s Increased Enforcement Scope with Compliance Week

News

10.14.22

In an interview with Compliance Week, Patrick Dalin shares his insight on OSHA’s Severe Violator Enforcement Program (SVEP), which has broadened its enforcement scope, thus putting more companies and industries at risk of violation. If OSHA finds at least two willful or repeated violations or issues a failure-to-abate notice for "high-gravity" serious violations, the employer can be placed on the SVEP list. Patrick explains that with a broadening of the criteria that includes all OSHA standards, every industry has an equal chance to end up on the list. "Companies will want to prepare as best as possible for an inspection or an investigation not just by OSHA but also other Labor Department agencies, like the Wage and Hour Division," he said.
