Partner Weighs-In on COVID-19 Vaccines and Employer Liability

In an interview with SHRM, Kevin Troutman discusses whether employers who are mandating or encouraging the COVID-19 vaccine can be held liable for employees’ adverse reactions. Kevin explains that employers that mandate or encourage employees to get vaccinated will likely partner with a health care provider or other authorized entity making it “unlikely that the employer itself would have administered the vaccine in the first place.” This would reduce potential liability for the employer, and the article goes on to explain that if employers are mandating vaccines that will likely be considered a part of work, which means that in most states adverse reactions would be covered by workers’ compensation.
