Partner Discusses Remote and Outdoor Worker Exemptions to the Federal Vaccine Mandate

In an interview with SHRM, Todd Logsdon weighs-in on exemptions to the federal vaccine mandate. While remote workers and workers who work exclusively outside are exempt from the federal mandate, Todd emphasizes that "the employee's work must truly occur outdoors, which does not include buildings under construction where substantial portions of the structure are in place, such as walls and ceiling elements that would impede the natural flow of fresh air at the worksite." Additionally, Todd advises that while some offices may consider moving more employees to remote work schedules, the employer should consider any other potential impacts of that decision on the worker, the work and the morale of the rest of the workplace.
