NLRB Revives Union Election Ideas In Proposed Rules

Corporate Counsel featured Tampa Partner Steve Bernstein in the February 10 article “NLRB Revives Union Election Ideas in Proposed Rules.”
The article discussed how the National Labor Relations Board approved a set of rules that would accelerate the union election process, allowing employers less time to prepare and to try and convince employees of the downsides of forming a union.
According to the article, the rules were thrown out when the U.S. district court in Washington, D.C., determined that the NLRB did not have the proper quorum to make valid decisions at the time the rules were approved.
Steve told CorpCounsel.com that he sees the proposed rule as a cure in search of a problem for the NLRB, as unions already win the majority of board elections for union recognition.
