With no statutory language addressing successorship rules, questions about when and if a new employer has a union bargaining duty has been the concern of administrative law judges, the National Labor Relations Board and appeals courts for decades. If the Supreme Court takes the case, it would provide an opportunity to define the balance between company and worker.
