New Jersey Strengthens Wage Theft Violation Laws

New Jersey Acting Governor Sheila Oliver signed into law Assembly Bill 2903 that ramps up penalties for violations of the state’s wage theft law. Employers in the Garden State are now facing increased financial penalties and first offenders could see prison sentences between 10 and 90 days. Kathie Caminiti, co-chair of the firm’s Wage and Hour practice, spoke with NJBiz on why it is often an accident based on employers not closely reviewing the requirements for exemption status. She suggests business owners double-check who is on the payroll and whether the workers are properly classified as hourly or salaried and exempt, or as independent contracts when they are actually employees.
