New Jersey’s New WARN Act Laws Cause Concern for Employers

Governor Phil Murphy signed S-3170 into law amending the state Worker Adjustment and Retraining Notification Act (WARN). The new law, effective in July, amends the law to count all employees, not just full-time ones, and will mandate severance pay of one week per year of service for employees losing their positions. There are also changes to threshold requirements and notice periods. In an interview with The New Jersey Law Journal, Alvaro Hasani explains the complications the new law brings for employers and recommends that employers who are considering a layoff in the near future proceed expeditiously now, before the law takes effect.
