New Jersey Attorney Discusses What Employers Need to Know About the New NLRB and FTC Partnership

In an interview with FTC Watch, Alba Aviles shares her insight on a new NLRB and FTC partnership that allows for more information sharing between the two organizations and could lead to more investigations into employers. She discusses what employers should know if ever caught in an investigation with either entity and explains that the MOU represents a troubling sign for gig economy businesses or any business with contractors. Alba also notes that reviewing business structures and agreements can help employers avoid having two agencies at the door. “I strongly encourage them to conduct internal audits to sort of assess the level of risk that they have either for misclassification or for any potential noncompete or nondisclosure agreements that could be considered anticompetitive, potentially, and any antipoaching agreements,” Alba added.
