McKnight’s Senior Living tapped Fisher Phillips attorneys for insight on their workplace law predictions for 2023. They expect the Department of Labor’s Occupational Health and Safety Administration to continue to be “aggressive” in 2023. They predict that the Biden administration will require all state-run OSHA plans to align penalties with federal OSHA, leading to “intense litigation and sparring over the size of penalties when workplace accidents occur.” They also predict that 2023 will bring substantial changes in labor relations, particularly with the National Labor Relations Board’s proposed “joint employer” rule expected to be finalized in August.
